User Agreement

Effective Date: July 26, 2025

Welcome, Artist. This User Agreement ("Terms") governs your access to and use of the Dream-Canvas.Art website, tools, and services (collectively, the "Service"), provided by Dream-Canvas.Art, LLC ("we," "us," or "our").

By creating an account or using our Service, you agree to be bound by these Terms. This is a legally binding agreement.

1. Your Relationship with Dream-Canvas.Art

Our vision is to provide you with a playground for creation, where you and AI can collaborate. We call you an "Artist" because we believe you are the essential creative force in that partnership. These terms are designed to protect you, your work, and the integrity of our community.

2. Your Account

To use our Service, you must create an account. You agree to provide accurate information and to keep your account password secure. You are responsible for all activity that occurs under your account. You must be at least 13 years old to use the Service.

3. Ownership of Content: You Own Your Creations

This is the cornerstone of our "Artists First, Always" philosophy.

• Your Content: You retain all ownership rights to the text prompts you write and any images you upload to the Service ("Your Content").
• Your Creations: You own the artwork you generate using the Service ("Creations"). Your creativity is the medium, and the final product belongs to you, subject to the terms below.

4. Your License to Us

To operate the Service, we need a limited license from you. By using the Service, you grant Dream-Canvas.Art a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display Your Content and Creations solely for the purpose of providing, maintaining, and improving the Service for you. For example, we need this license to save your Creations to your gallery and display them back to you.

If you choose to make any of your Creations public, you grant us a license to display that work publicly on the Service to promote your art and inspire the community.

5. Artist Conduct and Responsibilities

You are responsible for Your Content and Creations and your use of the Service. You agree not to use the Service to:

• Create content that is unlawful, harmful, defamatory, obscene, or hateful.
• Generate content that infringes upon any third party's intellectual property rights, including copyright and trademark.
• Create depictions of real people (including celebrities) in a manner that is deceptive, harmful, or violates their right to privacy or publicity.
• Attempt to reverse-engineer, decompile, or discover the source code of the Service.
• Use automated scripts or bots to access the Service in a way that could impair its performance.

We reserve the right to remove content and suspend or terminate accounts that violate these rules to protect our community.

6. The Service and Our Rights

The Service itself, including all software, branding, and design ("Our IP"), is the exclusive property of Dream-Canvas.Art, LLC and its licensors. We grant you a limited, non-exclusive, revocable license to access and use the Service as intended through our user interface.

7. Fees and Subscriptions (If Applicable)

Certain features of the Service may require payment. If you purchase a subscription, you agree to the pricing and payment terms presented to you. Subscriptions will automatically renew unless canceled. You may cancel your subscription at any time.

8. Termination

You are free to stop using our Service at any time. You can delete your account from your settings page.

We reserve the right to suspend or terminate your access to the Service at our discretion, without notice, if you violate these Terms or use the Service in a way that could cause us legal liability or disrupt others' use of the Service.

9. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED.

AI is a new and evolving technology. We do not guarantee that your Creations will be accurate or meet your expectations. The output may sometimes be unexpected.

TO THE FULLEST EXTENT PERMITTED BY LAW, DREAM-CANVAS.ART, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

10. Governing Law

These Terms shall be governed by the laws of the State of Florida, United States, without regard to its conflict of law principles.

11. Changes to These Terms

We may revise these Terms from time to time. We will notify you of any material changes by posting the new terms on the Service or by sending you an email. By continuing to use the Service after changes become effective, you agree to be bound by the revised Terms.
